Important — please read before completing your purchase. By ticking the checkbox on the payment page, you confirm you have read, understood, and agree to be bound by these Terms and Conditions. This constitutes a legally binding agreement between you and John Nguyen. If you do not agree, do not proceed with your purchase.

1 Definitions

In these Terms and Conditions, unless context requires otherwise:

  • "Agreement" means these Terms and Conditions together with the Program Schedule applicable to your enrolled program.
  • "Client" / "you" means the individual who purchases or enrols in a Coaching Program.
  • "Coach" / "I" means John Nguyen, ABN 51 204 223 453, trading as The Purpose Coach.
  • "Coaching Program" / "Program" means any of the programs described in Section 3.
  • "Group Program" means a Program delivered to multiple participants simultaneously.
  • "1:1 Program" means a Program delivered exclusively to you on an individual basis.
  • "Session" means a scheduled coaching call, video session, or live facilitated event forming part of your Program.
  • "Digital Materials" means any workbooks, frameworks, templates, guides, recordings, or other content provided as part of your Program.
  • "Business Day" means a day that is not a Saturday, Sunday, or public holiday in New South Wales, Australia.

2 Nature of Coaching Services

What Coaching Is

Coaching is a professional development partnership in which the Coach works collaboratively with the Client to identify goals, clarify thinking, navigate challenges, and take purposeful action. The Purpose Coach integrates faith, purpose, psychology, and practical growth.

Coaching outcomes depend significantly on the Client's active participation, honesty, and consistent engagement. The Coach facilitates; the Client creates their own results.

What Coaching Is Not

Coaching is not therapy, counselling, psychology, psychiatry, or any form of clinical or medical treatment. It is not a substitute for professional mental health support, medical advice, legal advice, or financial advice. See Section 10 for full details.

No Guaranteed Results

The Coach does not and cannot guarantee specific outcomes. Results vary depending on the individual Client's effort, circumstances, and engagement. Testimonials shared in marketing materials represent individual experiences and are not indicative of typical or guaranteed results.

3 Program Schedule

The following programs are offered under these Terms and Conditions. The program you have purchased is identified on your checkout confirmation and payment receipt.

Reignite
Free 3-Day Challenge · Monthly Cohort · Group
Fee: $0 — free Format: Online group, monthly cohort Duration: 3 consecutive days, ~15 mins/day Cohort size: Max 10 participants
  • Enrolment is subject to Coach approval. Submitting the form does not guarantee a place. The Coach will contact you within 48 hours to confirm.
  • Participants may withdraw at any time. Please notify the Coach as a courtesy.
Be Not Afraid
30-Day Group Coaching · $397 AUD
Fee: $397 AUD, payable in full before commencement Format: Online group coaching Duration: 30 days from cohort start date
  • Payment plans available at the Coach's discretion. All instalments must be completed regardless of whether the Client completes the Program.
  • Cancellation and refund terms: see Section 5.
Into the Deep
6-Session 1:1 Coaching · $997 AUD
Fee: $997 AUD, payable in full before first session Format: Individual video sessions (~60 mins each) Duration: 6 sessions within 6 months of commencement
  • Sessions not taken within 6 months of the commencement date are forfeited without refund.
  • Payment plan: 2 instalments of $550 AUD available at the Coach's discretion.
  • Between-session support via email or messaging at the Coach's reasonable availability.
  • Cancellation and refund terms: see Section 5.
Meant for More
12-Session 1:1 Coaching · $1,800 AUD
Fee: $1,800 AUD, payable in full before first session Format: Individual video sessions (~60–75 mins each) Duration: 12 sessions within 12 months of commencement
  • Sessions not taken within 12 months of the commencement date are forfeited without refund.
  • Payment plan: 3 instalments of $650 AUD available at the Coach's discretion.
  • Between-session support via email or messaging at the Coach's reasonable availability.
  • Cancellation and refund terms: see Section 5.

The Coach reserves the right to modify program formats, delivery methods, and pricing with reasonable notice. Changes will not affect programs already purchased.

4 Payment Terms

Payment in Full

Unless a payment plan has been expressly agreed in writing, full payment is required prior to the commencement of your Program. Access to Program materials and session bookings will not be provided until payment is received and confirmed.

Payment Plans

Where a payment plan is offered, the Client's obligation to pay all instalments is unconditional and does not depend on whether the Client continues to participate. Failure to pay an instalment within 7 days of its due date may result in suspension of access until the outstanding amount is settled.

Currency and GST

All fees are quoted in Australian Dollars (AUD). Where the Coach is registered for GST, fees include GST. A tax invoice will be issued upon payment.

Payment Processing

Payments are processed via Stripe or PayPal. The Coach does not store credit card or banking details. Payment processing is subject to the terms of the relevant third-party payment provider.

Failed Payments

Where a payment fails or is reversed, the Coach reserves the right to suspend or terminate the Client's access to the Program until the matter is resolved. The Client remains liable for all fees incurred.

5 Cancellation and Refund Policy

Australian Consumer Law: Nothing in this section limits, excludes, or modifies any rights you have under the Australian Consumer Law (ACL). See Section 14 for details.

Reignite (Free Program)

As Reignite is provided at no cost, no refund is applicable. If you cannot attend a cohort, please notify the Coach and you are welcome to register for a future cohort.

Change of Mind — Paid Programs

The Coach does not offer refunds for change of mind once a Program has commenced or once you have accessed any Program materials. Where you request cancellation before commencement and before accessing any materials, refund requests must be submitted in writing to john@thepurposecoach.com.au within 48 hours of purchase and will be considered on a case-by-case basis.

Partial Completion — 1:1 Programs

If you withdraw from Into the Deep or Meant for More after completing one or more sessions:

  • You will be refunded for sessions not yet taken, valued at $100 per session.
  • Any bonus sessions included in your package are forfeited upon cancellation and are not refundable.
  • An administrative fee of $75 applies to cover processing and setup costs already incurred.

Be Not Afraid — Group Program

Given the group nature of Be Not Afraid, partial refunds after commencement are not available, as the Coach's preparation and facilitation costs are incurred for the full cohort regardless of individual participation.

Full Refund Guarantee — 1:1 Programs

If you complete all sessions in your 1:1 Program within the applicable validity period and genuinely believe you received no benefit, you may request a full refund by contacting john@thepurposecoach.com.au within 14 days of your final session. The Coach reserves the right to request evidence of active participation before processing such a request.

How to Request a Refund

Submit all refund requests in writing to john@thepurposecoach.com.au with the subject line "Refund Request — [Program Name]". Include your full name, date of purchase, and reason for the request. The Coach will respond within 5 Business Days. Approved refunds will be processed to the original payment method within 10 Business Days of approval.

6 Rescheduling and Missed Sessions

Rescheduling by the Client

You may reschedule a booked session by providing at least 24 hours' notice prior to the scheduled session time. Requests with less than 24 hours' notice will be treated as a missed session.

Missed Sessions

Sessions missed without at least 24 hours' notice are charged at full rate and will not be rescheduled, except in genuine emergencies at the Coach's discretion.

Rescheduling by the Coach

Where the Coach needs to reschedule, you will be notified as soon as practicable and the session will be rescheduled at a mutually convenient time at no cost to you.

Session Reminders

The Coach does not provide automatic reminders. The Client is responsible for attending sessions at the agreed time. It is recommended that you add appointments to your own calendar.

7 Client Responsibilities

You agree to:

  • Engage honestly and openly in all coaching interactions
  • Take full responsibility for your own decisions, actions, and outcomes during and after the Program
  • Attend sessions punctually and consistently
  • Notify the Coach promptly if anything in the coaching relationship is not working for you
  • Disclose any prior diagnoses or circumstances that may affect the coaching
  • Seek appropriate professional support if issues arise that fall outside the scope of coaching
  • Not share, distribute, or reproduce Digital Materials without the Coach's prior written consent
  • Treat other participants in Group Programs with respect and maintain the confidentiality of what is shared within those groups

8 Coach Commitments

The Coach commits to:

  • Deliver sessions professionally and punctually
  • Maintain confidentiality of all information shared by you in accordance with Section 9
  • Be present, non-judgmental, and genuinely invested in your growth
  • Refer you to appropriate professionals when an issue falls outside the scope of coaching
  • Notify you promptly if a scheduling conflict arises and reschedule at no cost to you
  • Operate with integrity and in accordance with the ethical standards of the International Coaching Institute (ICI)

9 Confidentiality

Coach's Obligation

The Coach will keep confidential all personal, business, and spiritual information shared by you in the course of coaching. This obligation applies during and after the Program and does not expire.

The Coach will not disclose your information to any third party without your prior written consent, except where required by law, where there is a genuine risk of harm to you or another person, or where necessary for professional supervision with appropriate de-identification.

Group Program Confidentiality

In Group Programs (Reignite and Be Not Afraid), you agree to maintain the confidentiality of all information shared by other participants. What is shared within the group stays within the group. Breach of this obligation may result in immediate removal from the Program without refund.

Testimonials

The Coach may request your permission to use anonymised or attributed feedback for promotional purposes. This is entirely voluntary and will only proceed with your explicit written consent.

10 Not a Substitute for Professional Services

Please read this section carefully.

Coaching is not a clinical, therapeutic, or regulated professional service. By engaging in coaching, you acknowledge and agree that:

  • The Coach is not a licensed psychologist, psychiatrist, therapist, counsellor, social worker, medical practitioner, lawyer, or financial advisor
  • Nothing communicated in sessions constitutes medical advice, psychological treatment, legal advice, or financial advice
  • Coaching does not replace professional mental health support. If you are experiencing mental health difficulties or distress, seek qualified professional help immediately
  • If you have been diagnosed with a mental health condition or are under the care of a mental health professional, inform your treating practitioner about your participation in coaching
  • Any faith-based elements of the coaching are offered as personal reflection and formation support and are not spiritual direction, pastoral counselling, or sacramental ministry

11 Intellectual Property

Coach's Materials

All frameworks, workbooks, templates, videos, and Digital Materials provided as part of your Program are the intellectual property of John Nguyen and are protected by Australian copyright law. This includes the TRUST Framework, the 3P Framework, the Catholic Purpose Framework, and all associated materials.

Your Licence

By purchasing a Program, you are granted a personal, non-exclusive, non-transferable licence to use Digital Materials for your own personal development purposes only. You may not copy, distribute, use commercially, share access, or record sessions without prior written consent.

Your Content

Anything you share with the Coach remains yours. The Coach does not claim any rights over your personal content.

12 Privacy

John Nguyen is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

We collect your name, email address, phone number, and any personal information voluntarily shared through onboarding forms or sessions. This information is used to deliver your Program, confirm enrolment, and communicate with you. We will not sell or share your information with third parties for marketing purposes.

Your information may be stored on third-party platforms including Systeme.io, Zoom, and payment processors, subject to their own privacy policies.

To opt out of non-essential communications, update your personal information, or request access to data we hold about you, contact john@thepurposecoach.com.au.

13 Limitation of Liability

To the maximum extent permitted by law, and subject to Section 14:

  • The Coach's total liability for any claim is limited to the total fees paid by you for the relevant Program
  • The Coach is not liable for any indirect, incidental, or consequential loss, including loss of income, opportunity, or profit
  • The Coach is not responsible for decisions made by you as a result of coaching, including career, business, relationship, or other life choices
  • The Coach is not liable for technical issues or third-party platform failures, provided reasonable efforts are made to reschedule

Nothing in this section excludes liability for personal injury or death caused by negligence, or for fraud.

14 Australian Consumer Law

Your statutory rights are protected. The following statement is required under Australian law.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the service. Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any right or remedy you have under the ACL.

15 Termination

The Coach reserves the right to terminate the coaching relationship immediately where the Client engages in abusive, harassing, or threatening behaviour; breaches confidentiality obligations; provides materially false information; or fails to pay fees as required. Where termination occurs due to conduct, any refund entitlements will be considered under the ACL on a case-by-case basis.

You may terminate your participation at any time by notifying the Coach in writing. Refund entitlements on early termination are governed by Section 5 and the ACL.

16 Governing Law and Dispute Resolution

This Agreement is governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

If a dispute arises, both parties agree to make a genuine effort to resolve it through direct communication before pursuing formal legal remedies. Contact the Coach in writing at john@thepurposecoach.com.au. If not resolved within 30 days, either party may refer the matter to a mediator appointed by the Australian Mediation Association before commencing any litigation.

17 Electronic Agreement

By ticking the checkbox on the payment or registration page stating "I agree to the Terms and Conditions," you confirm that you have read and understood these Terms and Conditions, agree to be legally bound by this Agreement, are at least 18 years of age, and that the information you have provided is accurate.

Electronic acceptance via checkbox constitutes a binding agreement under Australian law, consistent with the Electronic Transactions Act 1999 (Cth). No wet signature is required. The Coach will retain a record of your acceptance including the date, time, and IP address as provided by the booking platform.
