In these Terms and Conditions, unless context requires otherwise:
Coaching is a professional development partnership in which the Coach works collaboratively with the Client to identify goals, clarify thinking, navigate challenges, and take purposeful action. The Purpose Coach integrates faith, purpose, psychology, and practical growth.
Coaching outcomes depend significantly on the Client's active participation, honesty, and consistent engagement. The Coach facilitates; the Client creates their own results.
The Coach does not and cannot guarantee specific outcomes. Results vary depending on the individual Client's effort, circumstances, and engagement. Testimonials shared in marketing materials represent individual experiences and are not indicative of typical or guaranteed results.
The following programs are offered under these Terms and Conditions. The program you have purchased is identified on your checkout confirmation and payment receipt.
The Coach reserves the right to modify program formats, delivery methods, and pricing with reasonable notice. Changes will not affect programs already purchased.
Unless a payment plan has been expressly agreed in writing, full payment is required prior to the commencement of your Program. Access to Program materials and session bookings will not be provided until payment is received and confirmed.
Where a payment plan is offered, the Client's obligation to pay all instalments is unconditional and does not depend on whether the Client continues to participate. Failure to pay an instalment within 7 days of its due date may result in suspension of access until the outstanding amount is settled.
All fees are quoted in Australian Dollars (AUD). Where the Coach is registered for GST, fees include GST. A tax invoice will be issued upon payment.
Payments are processed via Stripe or PayPal. The Coach does not store credit card or banking details. Payment processing is subject to the terms of the relevant third-party payment provider.
Where a payment fails or is reversed, the Coach reserves the right to suspend or terminate the Client's access to the Program until the matter is resolved. The Client remains liable for all fees incurred.
As Reignite is provided at no cost, no refund is applicable. If you cannot attend a cohort, please notify the Coach and you are welcome to register for a future cohort.
The Coach does not offer refunds for change of mind once a Program has commenced or once you have accessed any Program materials. Where you request cancellation before commencement and before accessing any materials, refund requests must be submitted in writing to john@thepurposecoach.com.au within 48 hours of purchase and will be considered on a case-by-case basis.
If you withdraw from Into the Deep or Meant for More after completing one or more sessions:
Given the group nature of Be Not Afraid, partial refunds after commencement are not available, as the Coach's preparation and facilitation costs are incurred for the full cohort regardless of individual participation.
If you complete all sessions in your 1:1 Program within the applicable validity period and genuinely believe you received no benefit, you may request a full refund by contacting john@thepurposecoach.com.au within 14 days of your final session. The Coach reserves the right to request evidence of active participation before processing such a request.
Submit all refund requests in writing to john@thepurposecoach.com.au with the subject line "Refund Request — [Program Name]". Include your full name, date of purchase, and reason for the request. The Coach will respond within 5 Business Days. Approved refunds will be processed to the original payment method within 10 Business Days of approval.
You may reschedule a booked session by providing at least 24 hours' notice prior to the scheduled session time. Requests with less than 24 hours' notice will be treated as a missed session.
Sessions missed without at least 24 hours' notice are charged at full rate and will not be rescheduled, except in genuine emergencies at the Coach's discretion.
Where the Coach needs to reschedule, you will be notified as soon as practicable and the session will be rescheduled at a mutually convenient time at no cost to you.
The Coach does not provide automatic reminders. The Client is responsible for attending sessions at the agreed time. It is recommended that you add appointments to your own calendar.

The Coach will keep confidential all personal, business, and spiritual information shared by you in the course of coaching. This obligation applies during and after the Program and does not expire.
The Coach will not disclose your information to any third party without your prior written consent, except where required by law, where there is a genuine risk of harm to you or another person, or where necessary for professional supervision with appropriate de-identification.
In Group Programs (Reignite and Be Not Afraid), you agree to maintain the confidentiality of all information shared by other participants. What is shared within the group stays within the group. Breach of this obligation may result in immediate removal from the Program without refund.
The Coach may request your permission to use anonymised or attributed feedback for promotional purposes. This is entirely voluntary and will only proceed with your explicit written consent.
Coaching is not a clinical, therapeutic, or regulated professional service. By engaging in coaching, you acknowledge and agree that:

All frameworks, workbooks, templates, videos, and Digital Materials provided as part of your Program are the intellectual property of John Nguyen and are protected by Australian copyright law. This includes the TRUST Framework, the 3P Framework, the Catholic Purpose Framework, and all associated materials.
By purchasing a Program, you are granted a personal, non-exclusive, non-transferable licence to use Digital Materials for your own personal development purposes only. You may not copy, distribute, use commercially, share access, or record sessions without prior written consent.
Anything you share with the Coach remains yours. The Coach does not claim any rights over your personal content.
John Nguyen is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
We collect your name, email address, phone number, and any personal information voluntarily shared through onboarding forms or sessions. This information is used to deliver your Program, confirm enrolment, and communicate with you. We will not sell or share your information with third parties for marketing purposes.
Your information may be stored on third-party platforms including Systeme.io, Zoom, and payment processors, subject to their own privacy policies.
To opt out of non-essential communications, update your personal information, or request access to data we hold about you, contact john@thepurposecoach.com.au.
To the maximum extent permitted by law, and subject to Section 14:
Nothing in this section excludes liability for personal injury or death caused by negligence, or for fraud.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the service. Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any right or remedy you have under the ACL.
The Coach reserves the right to terminate the coaching relationship immediately where the Client engages in abusive, harassing, or threatening behaviour; breaches confidentiality obligations; provides materially false information; or fails to pay fees as required. Where termination occurs due to conduct, any refund entitlements will be considered under the ACL on a case-by-case basis.
You may terminate your participation at any time by notifying the Coach in writing. Refund entitlements on early termination are governed by Section 5 and the ACL.
This Agreement is governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
If a dispute arises, both parties agree to make a genuine effort to resolve it through direct communication before pursuing formal legal remedies. Contact the Coach in writing at john@thepurposecoach.com.au. If not resolved within 30 days, either party may refer the matter to a mediator appointed by the Australian Mediation Association before commencing any litigation.
By ticking the checkbox on the payment or registration page stating "I agree to the Terms and Conditions," you confirm that you have read and understood these Terms and Conditions, agree to be legally bound by this Agreement, are at least 18 years of age, and that the information you have provided is accurate.
Electronic acceptance via checkbox constitutes a binding agreement under Australian law, consistent with the Electronic Transactions Act 1999 (Cth). No wet signature is required. The Coach will retain a record of your acceptance including the date, time, and IP address as provided by the booking platform.
