Terms & Conditions

1 Definitions

In these Terms and Conditions, unless context requires otherwise:

• "Agreement" means these Terms and Conditions together with the Program Schedule applicable to your enrolled program.
• "Client" / "you" means the individual who purchases or enrols in a Coaching Program.
• "Coach" / "I" means John Nguyen, ABN 51 204 223 453, trading as The Purpose Coach.
• "Coaching Program" / "Program" means any of the programs described in Section 3.
• "Group Program" means a Program delivered to multiple participants simultaneously.
• "1:1 Program" means a Program delivered exclusively to you on an individual basis.
• "Session" means a scheduled coaching call, video session, or live facilitated event forming part of your Program.
• "Bookend Call" means one of the two individual one hour video calls included in Into the Deep, one at the beginning of the cohort and one at its conclusion.
• "Check-In Call" means the monthly group accountability call forming part of the Iron Sharpens Iron Program.
• "The Full Journey" means the combined enrolment in Be Not Afraid and Into the Deep purchased together as described in Section 3.
• "Founding Round" means the first round of a Program offered at a founding rate, available once only.
• "Program Credit" means non-cash credit issued under Section 6, redeemable only against the purchase of a Program.
• "Emmaus Upgrade" means individual one to one coaching sessions purchased as an add-on to any Program, as described in Section 3.
• "Referral Credit" means Program Credit issued to a Referrer under Section 6 where a person they invited enrols in and pays for Be Not Afraid.
• "Gift Seat" means one complimentary place in Be Not Afraid which a purchaser of Into the Deep or Meant for More may give to another person, as described in Section 6.
• "Scholarship" means the prize awarded under the Reignite Scholarship described in Section 5.
• "Referrer" means a person who has previously participated in or registered for a Program and who is nominated by name on a Reignite registration form as the person who invited that registrant.
• "Digital Materials" means any workbooks, frameworks, templates, guides, recordings, or other content provided as part of your Program.
• "Business Day" means a day that is not a Saturday, Sunday, or public holiday in New South Wales, Australia.

2 Nature of Coaching Services

What Coaching Is

Coaching is a professional development partnership in which the Coach works collaboratively with the Client to identify goals, clarify thinking, navigate challenges, and take purposeful action. The Purpose Coach integrates faith, purpose, psychology, and practical growth.

Coaching outcomes depend significantly on the Client's active participation, honesty, and consistent engagement. The Coach facilitates; the Client creates their own results.

What Coaching Is Not

No Guaranteed Results

The Coach does not and cannot guarantee specific outcomes. Results vary depending on the individual Client's effort, circumstances, and engagement. Testimonials shared in marketing materials represent individual experiences and are not indicative of typical or guaranteed results.

Group Coaching

Most Programs offered by The Purpose Coach are delivered in a group format. Group Programs involve live facilitated sessions in which participants may be coached individually in front of the group. Participation in group discussion is encouraged but never compelled. You may decline to speak at any time.

3 Program Schedule

The following programs are offered under these Terms and Conditions. The program you have purchased is identified on your checkout confirmation and payment receipt. Program fees, cohort dates, and participant caps are published at the point of enrolment and may vary between rounds.

The Coach reserves the right to modify program formats, delivery methods, and pricing with reasonable notice. Changes will not affect programs already purchased.

4 Payment Terms

Published Pricing

All fees are published before purchase and are the same for every Client buying the same thing on the same terms. The Coach does not negotiate individual fees, does not reduce a published fee in response to a Client declining it, and does not offer an unadvertised lower price for a Program or package already declined. Where a price differs, it is because what is being purchased differs, such as the number of sessions bought at one time or a Founding Round place, and the difference is published in advance and open to anyone on the same terms.

Where a Program's fee is scheduled to change, the Coach may state the future fee. The Coach does not present a fee as a former or usual price unless the Program has actually been sold at that fee.

Payment in Full

Unless a payment plan has been expressly agreed in writing, full payment is required prior to the commencement of your Program. Access to Program materials and session bookings will not be provided until payment is received and confirmed.

Payment Plans

Where a payment plan is offered, the Client's obligation to pay all instalments is unconditional and does not depend on whether the Client continues to participate. Failure to pay an instalment within 7 days of its due date may result in suspension of access until the outstanding amount is settled.

Recurring Subscriptions

Iron Sharpens Iron is charged as a recurring monthly subscription. By enrolling, you authorise the Coach to charge your nominated payment method the monthly fee on the same date each month until you cancel. You may cancel at any time by written notice to the Coach or through the subscription management link provided. Cancellation takes effect at the end of the month already paid for.

Currency and GST

All fees are quoted in Australian Dollars (AUD). Where the Coach is registered for GST, fees include GST. A tax invoice will be issued upon payment.

Payment Processing

Payments are processed via Stripe or PayPal. The Coach does not store credit card or banking details. Payment processing is subject to the terms of the relevant third-party payment provider.

Failed Payments

Where a payment fails or is reversed, the Coach reserves the right to suspend or terminate the Client's access to the Program until the matter is resolved. The Client remains liable for all fees incurred.

5 The Reignite Scholarship

The Prize

One Scholarship is awarded in each round of Reignite. The Scholarship comprises one complimentary place in The Full Journey, being Be Not Afraid and the next available Into the Deep cohort. The prize value is stated on the registration page for each round.

The Scholarship has no cash value, is not transferable to any other person, and cannot be exchanged, sold, or redeemed for cash or for any other Program.

Eligibility

To be eligible for consideration, a participant must:

• Be aged 18 years or over and resident in Australia;
• Have registered for the round through the official registration form and had their place confirmed by the Coach;
• Attend all three nights of the round; and
• Submit all three nightly reflection forms.

Failure to meet any of these conditions renders a participant ineligible. Eligibility conditions are objective and are not subject to the Coach's discretion.

How the Winner is Determined

The Coach assesses all eligible participants against these three criteria using the participants' own nightly reflection form responses and their participation in the live sessions. The Coach acts as sole judge.

The criteria above are published on the registration page and stated aloud during the round before judging occurs.

Announcement and Claim

• The winner is announced live during the final night of the round. A participant must be present on the final night to be awarded the Scholarship.
• The winner is notified in writing by email within 2 Business Days of the announcement.
• The Scholarship must be claimed within 14 days of the date of the written notification. To claim, the winner must reply in writing accepting the Scholarship. A Scholarship not claimed within 14 days is forfeited in full and no substitute is offered.

Ties and Final Decisions

Where the Coach assesses two or more participants as equal against the criteria, the Coach will determine the winner by applying the criteria in the order listed above. The Coach's decision is final. No correspondence will be entered into. No element of chance is used to resolve a tie at any stage.

Referrer Scholarship

Where the participant awarded the Scholarship nominated a Referrer by name on their registration form, the Scholarship is awarded to that participant and to their nominated Referrer. Both awards arise from the single determination described above.

The following conditions apply:

• A Referrer must be nominated by name on the registration form at the time of registration. Referrals claimed after registration closes are not recognised.
• Each registrant may nominate one Referrer only.
• The Referrer award applies in one direction only. A Referrer does not confer any Scholarship entitlement on the participants they referred. A Referrer may be nominated by more than one registrant.
• A Referrer who receives a Scholarship must claim it within 14 days of written notification, on the same terms as the winning participant. An unclaimed Referrer Scholarship is forfeited in full.
• The Referrer Scholarship has no cash value, is not transferable, and cannot be exchanged for any other Program.
• A Referrer must be aged 18 years or over and resident in Australia.

General Competition Terms

• Entry is free. No purchase is necessary to enter or to win.
• The promoter is John Nguyen, ABN 51 204 223 453, trading as The Purpose Coach, Sydney NSW.
• Employees of the promoter and their immediate families are not eligible.
• The Coach reserves the right to disqualify any participant who, in the Coach's reasonable opinion, has provided false information, breached these Terms, or engaged in conduct inconsistent with the spirit of the round.
• The Coach reserves the right to withhold the Scholarship in any round where, in the Coach's reasonable assessment, no participant has met the criteria to a standard warranting the award.
• The Coach may vary or cancel the Scholarship for future rounds. Any such change does not affect a round already open for registration.
• Winners may be asked to consent to their first name and a short description of their actions being published. Consent is voluntary and is not a condition of receiving the Scholarship.

6 Credits, Referrals and Gift Seats

What It Is

The Win Your Money Back Guarantee applies to Be Not Afraid, including where Be Not Afraid is purchased as part of The Full Journey. Where a Client completes all four requirements below, the Coach will issue Program Credit to the value of $200 AUD.

The Four Requirements

To qualify, the Client must, within the 30-day round:

1. Complete the daily mini challenges;
2. Complete the weekly reflections;
3. Complete the weekly confidence challenges the Client has set for themselves; and
4. Submit a written testimonial no later than 7 days after the final session of the round.

Completion is evidenced by the Client's submissions through the forms and channels provided during the round. The Coach will confirm in writing within 10 Business Days of the round concluding whether the requirements have been met.

What the Credit Can Be Used For

• For Clients who purchased Be Not Afraid alone, the Credit is redeemable against Into the Deep.
• For Clients who purchased The Full Journey, the Credit is redeemable against Meant for More or Iron Sharpens Iron.

Credit Terms

• Program Credit is store credit only. It has no cash value and cannot be redeemed for cash under any circumstances.
• Program Credit is personal to the Client and is not transferable to any other person.
• Program Credit expires 12 months from the date of issue. Credit not redeemed within that period is forfeited in full.
• Program Credit is applied as a reduction against the published fee of the eligible Program at the time of redemption. It cannot be combined with any other discount or promotional rate unless the Coach agrees in writing.
• Where a Client purchased Be Not Afraid on a payment plan, Credit is issued only once all instalments have been paid in full.
• Program Credit is issued once per Client per round. It cannot be accumulated across multiple rounds.
• Where a Client redeems Program Credit against a Program and subsequently cancels that Program, the Credit is not reissued and no refund of the Credit value is payable.
• The Emmaus Upgrade is not covered by this Guarantee. Emmaus Upgrade sessions do not count toward the four requirements, and Program Credit cannot be redeemed against the purchase of Emmaus Upgrade sessions.

Referral Credit

Where a person nominates you by name as their Referrer on their Reignite registration form, and that person subsequently enrols in and pays in full for Be Not Afraid, the Coach will issue you Referral Credit to the value of $100 AUD.

• The person you invited pays the full published fee. No discount, reduced rate, or part payment applies to their enrolment, and they remain eligible for the Win Your Money Back Guarantee in their own right.
• Referral Credit is issued per referred person and is capped at $300 AUD per Client in total, across all rounds and all time. Referrals beyond that cap do not attract further Credit.
• Nomination operates in one direction only. Being nominated as a Referrer does not entitle the person you invited to any credit, and you cannot nominate each other reciprocally for the same round.
• Nomination must be made on the registration form at the time of registration. Referrals cannot be claimed, added, or backdated afterwards.
• Referral Credit is issued within 10 Business Days of the referred person's enrolment being paid in full, and is void where that enrolment is later refunded, reversed, or cancelled.
• Referral Credit is Program Credit and is subject to every Credit Term above, including the 12-month expiry and the prohibition on cash redemption.

Limit on Total Credit

Regardless of how it was earned, the total Program Credit a Client may redeem against any single Program is capped at 50 per cent of that Program's published fee at the time of redemption. Credit in excess of that cap remains available for a future Program, subject to its expiry date. This cap applies to Win Your Money Back Credit, Referral Credit, and any combination of the two.

Gift Seats

Each purchase of Into the Deep or Meant for More includes one Gift Seat: a single complimentary place in Be Not Afraid for a person of your choosing.

• The recipient must be named at the time of your own enrolment. A Gift Seat cannot be held open, transferred to a different person once named, or exchanged for credit, a discount, or cash.
• The recipient must be a person who has not previously enrolled in Be Not Afraid.
• The recipient must claim the seat in a round commencing within 12 months of issue, subject to places being available in that round.
• A Gift Seat recipient is a participant on the same terms as any other, and is eligible for the Win Your Money Back Guarantee only to the extent of the amount they personally paid, which where the seat is complimentary is nil.
• Founding members additionally hold one complimentary Reignite place to give away, as described in Section 3. That place is separate from a Gift Seat.

Testimonials

Submission of a written testimonial is a requirement of this Guarantee. By submitting a testimonial, you grant the Coach a non-exclusive, royalty-free licence to reproduce it in marketing materials. You may request that your testimonial be published anonymously or under your first name only. You may withdraw consent to future publication at any time by written notice, which does not affect materials already printed or distributed.

7 Cancellation and Refund Policy

Reignite (Free Program)

As Reignite is provided at no cost, no refund is applicable. If you cannot attend a round, please notify the Coach and you are welcome to apply for a future round.

Change of Mind, Paid Programs

The Coach does not offer refunds for change of mind once a Program has commenced or once you have accessed any Program materials. Where you request cancellation before commencement and before accessing any materials, refund requests must be submitted in writing to john@thepurposecoach.com.au within 48 hours of purchase and will be considered on a case-by-case basis.

Be Not Afraid, Group Program

Given the group nature of Be Not Afraid, partial refunds after commencement are not available, as the Coach's preparation and facilitation costs are incurred for the full round regardless of individual participation.

Into the Deep, Group Program

If you withdraw from Into the Deep after the cohort has commenced:

• Group sessions are not refundable, as the Coach's preparation and facilitation costs are incurred for the full cohort regardless of individual participation.
• You will be refunded for any Bookend Call not yet taken, valued at $100 per call.
• An administrative fee of $75 applies to cover processing and setup costs already incurred.

The Full Journey

If you withdraw from The Full Journey, the refund payable is calculated by reference to the components not yet commenced:

• Where you withdraw before Be Not Afraid commences, refund requests are handled under the Change of Mind provisions above.
• Where you withdraw after Be Not Afraid has commenced but before Into the Deep commences, you will be refunded $597, less an administrative fee of $75.
• Where you withdraw after Into the Deep has commenced, the Into the Deep provisions above apply.
• Founding member entitlements cease on withdrawal and have no cash value.

Partial Completion, Meant for More

If you withdraw from Meant for More after completing one or more sessions:

• You will be refunded for sessions not yet taken, valued at $180 per session.
• The included 3 months of Iron Sharpens Iron is forfeited upon cancellation and is not refundable.
• An administrative fee of $75 applies to cover processing and setup costs already incurred.

Iron Sharpens Iron

Iron Sharpens Iron is a monthly subscription with no lock-in period. You may cancel at any time and your access continues to the end of the month already paid for. Fees already paid for the current month are not refunded.

The Emmaus Upgrade

Emmaus Upgrade sessions are not refundable once purchased, and sessions not yet taken carry no refund value. Where you cancel a Program to which Emmaus Upgrade sessions were attached, the sessions already purchased remain available to you for the balance of their 12-month validity period and are not refunded. Nothing in this paragraph limits your rights under the Australian Consumer Law, and where a session is not delivered at all the fee for that session is refundable.

Where a Client purchased sessions at the reduced with-Program rates of $497 for 3 or $1,097 for 7 and takes only part of them before cancelling, no adjustment is made to the rate paid and no top-up charge applies.

Full Refund Guarantee, Meant for More

If you complete all 12 sessions of Meant for More within the applicable validity period and genuinely believe you received no benefit, you may request a full refund by contacting john@thepurposecoach.com.au within 14 days of your final session. The Coach reserves the right to request evidence of active participation before processing such a request.

Performance Guarantee, Meant for More

In addition to the Full Refund Guarantee above, Clients who complete the Meant for More Program may elect an alternative remedy. Where the Client has, in the Coach's reasonable assessment: (a) attended and actively participated in all 12 sessions; (b) completed the reflection homework between sessions; and (c) made a genuine attempt at the actions committed to during the Program, and the Client genuinely does not have a clear understanding of their purpose by the end of the final session, the Client may elect, in writing within 7 days of the final session, one of the following:

• Option One, Full Refund: a full refund of the Program fee, processed to the original payment method within 5 Business Days of approval; or
• Option Two, Continued Coaching: continued individual coaching sessions at no additional charge, delivered at the same session rhythm as the Program, until the Client and Coach mutually agree that the Client has reached a clear understanding of their purpose and direction.

The following conditions apply to Option Two: continued coaching under this guarantee is personal to the Client and is not transferable; it has no cash or refund value and cannot later be exchanged for Option One; it is conditional on the Client's continued genuine participation, including attendance and completion of agreed actions, and may be concluded by the Coach if the Client ceases to genuinely participate; and scheduling remains subject to the Coach's reasonable availability. Election of either Option is final.

How to Request a Refund

Submit all refund requests in writing to john@thepurposecoach.com.au with the subject line "Refund Request, [Program Name]". Include your full name, date of purchase, and reason for the request. The Coach will respond within 5 Business Days. Approved refunds will be processed to the original payment method within 10 Business Days of approval.

8 Rescheduling and Missed Sessions

Group Sessions

Group sessions in Reignite, Be Not Afraid, Into the Deep, and Iron Sharpens Iron run to a fixed published schedule. Group sessions are not rescheduled for individual participants. Where a recording is available it will be provided.

Individual Sessions and Bookend Calls

You may reschedule a booked individual session or Bookend Call by providing at least 24 hours' notice prior to the scheduled time. Requests with less than 24 hours' notice will be treated as a missed session.

Missed Individual Sessions

Individual sessions and Bookend Calls missed without at least 24 hours' notice are charged at full rate and will not be rescheduled, except in genuine emergencies at the Coach's discretion.

Rescheduling by the Coach

Where the Coach needs to reschedule, you will be notified as soon as practicable and the session will be rescheduled at a mutually convenient time at no cost to you. Where a group session is rescheduled, the Coach will give as much notice as is practicable.

Session Reminders

The Coach does not provide automatic reminders. The Client is responsible for attending sessions at the agreed time. It is recommended that you add appointments to your own calendar.

9 Recordings

Group sessions may be recorded for the benefit of participants who cannot attend live and for the Coach's own review. Where a session is recorded, this will be stated at the start of the session.

Recordings are made available to participants of that Program only and are subject to the licence terms in Section 13. You may not share, distribute, or publish any recording.

If you do not wish to appear in a recording, you may turn off your camera and microphone during the recorded portion. Please notify the Coach in advance if you have concerns.

Individual sessions and Bookend Calls are not recorded unless both parties agree in advance.

The Coach may use short excerpts of recorded group sessions for promotional purposes only where every identifiable participant appearing in that excerpt has given prior written consent.

10 Client Responsibilities

You agree to:

• Engage honestly and openly in all coaching interactions
• Take full responsibility for your own decisions, actions, and outcomes during and after the Program
• Attend sessions punctually and consistently
• Notify the Coach promptly if anything in the coaching relationship is not working for you
• Disclose any prior diagnoses or circumstances that may affect the coaching
• Seek appropriate professional support if issues arise that fall outside the scope of coaching
• Not share, distribute, or reproduce Digital Materials or recordings without the Coach's prior written consent
• Treat other participants in Group Programs with respect and maintain the confidentiality of what is shared within those groups

11 Coach Commitments

The Coach commits to:

• Deliver sessions professionally and punctually
• Maintain confidentiality of all information shared by you in accordance with Section 14
• Be present, non-judgmental, and genuinely invested in your growth
• Refer you to appropriate professionals when an issue falls outside the scope of coaching
• Notify you promptly if a scheduling conflict arises and reschedule at no cost to you
• Operate with integrity and in accordance with the ethical standards of the International Coaching Institute (ICI)

12 Not a Substitute for Professional Services

Coaching is not a clinical, therapeutic, or regulated professional service. By engaging in coaching, you acknowledge and agree that:

• The Coach is not a licensed psychologist, psychiatrist, therapist, counsellor, social worker, medical practitioner, lawyer, or financial advisor
• Nothing communicated in sessions constitutes medical advice, psychological treatment, legal advice, or financial advice
• Coaching does not replace professional mental health support. If you are experiencing mental health difficulties or distress, seek qualified professional help immediately
• If you have been diagnosed with a mental health condition or are under the care of a mental health professional, inform your treating practitioner about your participation in coaching
• Any faith-based elements of the coaching are offered as personal reflection and formation support and are not spiritual direction, pastoral counselling, or sacramental ministry

13 Intellectual Property

Coach's Materials

All frameworks, workbooks, templates, videos, recordings, and Digital Materials provided as part of your Program are the intellectual property of John Nguyen and are protected by Australian copyright law. This includes the TRUST Framework, the 3P Framework, the Catholic Purpose Framework, and all associated materials.

Your Licence

By purchasing a Program, you are granted a personal, non-exclusive, non-transferable licence to use Digital Materials and recordings for your own personal development purposes only. You may not copy, distribute, use commercially, share access, or make your own recording of sessions without prior written consent.

Where your Program includes retention of recordings beyond the Program period, that licence continues on the same terms.

Your Content

Anything you share with the Coach remains yours. The Coach does not claim any rights over your personal content, subject only to the testimonial licence in Section 6 where applicable.

14 Confidentiality

Coach's Obligation

The Coach will keep confidential all personal, business, and spiritual information shared by you in the course of coaching. This obligation applies during and after the Program and does not expire.

The Coach will not disclose your information to any third party without your prior written consent, except where required by law, where there is a genuine risk of harm to you or another person, or where necessary for professional supervision with appropriate de-identification.

Group Program Confidentiality

In Group Programs, you agree to maintain the confidentiality of all information shared by other participants. What is shared within the group stays within the group. Breach of this obligation may result in immediate removal from the Program without refund.

Community Access

Where your Program includes access to a private online community, the same confidentiality obligation applies to everything posted within it. You may not screenshot, copy, or share the contributions of other members outside the community.

15 Privacy

John Nguyen is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

We collect your name, email address, phone number, the name of any Referrer you nominate, and any personal information voluntarily shared through application forms, reflection forms, or sessions. This information is used to deliver your Program, confirm enrolment, assess Scholarship eligibility, and communicate with you. We will not sell or share your information with third parties for marketing purposes.

Where you nominate a Referrer, we will contact that person only if they become entitled to a Scholarship under Section 5.

Your information may be stored on third-party platforms including Systeme.io, Google, Zoom, and payment processors, subject to their own privacy policies.

To opt out of non-essential communications, update your personal information, or request access to data we hold about you, contact john@thepurposecoach.com.au.

16 Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the service. Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any right or remedy you have under the ACL.

The Win Your Money Back Guarantee in Section 6 and the guarantees in Section 7 are offered voluntarily by the Coach in addition to your statutory rights. They do not replace or limit them.

17 Limitation of Liability

To the maximum extent permitted by law, and subject to Section 16:

• The Coach's total liability for any claim is limited to the total fees paid by you for the relevant Program
• The Coach is not liable for any indirect, incidental, or consequential loss, including loss of income, opportunity, or profit
• The Coach is not responsible for decisions made by you as a result of coaching, including career, business, relationship, or other life choices
• The Coach is not liable for technical issues or third-party platform failures, provided reasonable efforts are made to reschedule
• The Coach is not liable for the conduct of other participants in Group Programs, including any breach by them of the confidentiality obligations in Section 14

Nothing in this section excludes liability for personal injury or death caused by negligence, or for fraud.

18 Termination

The Coach reserves the right to terminate the coaching relationship immediately where the Client engages in abusive, harassing, or threatening behaviour; breaches confidentiality obligations; provides materially false information; or fails to pay fees as required. Where termination occurs due to conduct, any refund entitlements will be considered under the ACL on a case-by-case basis.

You may terminate your participation at any time by notifying the Coach in writing. Refund entitlements on early termination are governed by Section 7 and the ACL.

On termination for any reason, any unredeemed Program Credit is forfeited and founding member entitlements cease.

19 Governing Law and Dispute Resolution

This Agreement is governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

If a dispute arises, both parties agree to make a genuine effort to resolve it through direct communication before pursuing formal legal remedies. Contact the Coach in writing at john@thepurposecoach.com.au. If not resolved within 30 days, either party may refer the matter to a mediator appointed by the Australian Mediation Association before commencing any litigation.

20 Electronic Agreement

By ticking the checkbox on the payment or registration page stating "I agree to the Terms and Conditions," you confirm that you have read and understood these Terms and Conditions, agree to be legally bound by this Agreement, are at least 18 years of age, and that the information you have provided is accurate.
